On November 15, 2002,
the North Dakota Supreme Court issued a decision in a lawyer
discipline case entitled, Jacobson v. Garaas, 2002 ND 181, 652 N.W.2d
918.
The ND Supreme Court ruled that Attorney Garaas's in court statements
were not protected by the First Amendment.
The ND Supreme Court took offense at Mr. Garaas's statement that the
ND Supreme Court had "falsely represented" the issues that his client
had previously appealed. The ND Supreme Court stated:
"While a lawyer is certainly free to register his disagreement with a
court's ruling, he must do so without showing disrespect to the
court. Garaas's statement that this Court made a 'false
representation' carries a connotation of intentional wrongful
conduct. We conclude Garaas's statement crossed the line beyond
criticism to disrespectful assertion of wrongdoing by the Court, and
constitutes a violation of N.D.R. Prof. Conduct 8.4(e)."

Attorney Garaas was publicly reprimanded and ordered to pay the costs
of the disciplinary proceedings in the amount of $7,312.42.
The ND Supreme Court is sending all lawyers a message: "Don't
criticize this Court, don't even imply that we might be wrong about
anything, or we'll find you guilty of misconduct and make you pay."
The ND Supreme Court has a website. Every week, it e-publishes a
new "Appellate Tip of the Week." To NAIL down the BIG CHILL on
lawyer speech, the ND Supreme Court has--for the last three weeks--
featured the Jacobson v. Garaas case.
